(hereinafter, “MY IRC,” or “we”) (Company No. 1326202-V) values privacy and is dedicated to protecting Personal Information (as described below) held by us in line with legislation (including the Personal Data Protection Act, 2010), this Privacy Notice, and our Terms of Use (“Terms of Use”). For the avoidance of doubt, the words used in this Privacy Policy have the same meaning as the phrases used in the Terms of Use, unless the context indicates otherwise. This Privacy Policy explains how we gather your Personal Information when you download and use the e-kupon app for smartphones and other mobile devices (the “App”), the use and availability of the website https://www.e-kupon.com.my (“Website”) (collectively, with the App, “Platform”), as well as all content, products, services, and functions available on or through the Application and Website (collectively, with the Platform, “Services”) The following is an explanation of the Privacy Policy:
  •  The forms of personal data we collect and how it is collected;
  •  How we use your data;
  •  Parties to whom we may expose such personal data; and
  •  The alternatives we provide, such as how to view and update your data.

    If there is a conflict between Bahasa Melayu and versions with other languages, the Malay version will take precedence. You agree to the terms of this Privacy Policy by using our services, and you are deemed to have given your consent to the collection, use, and dissemination of your data by this Privacy Policy.

    The types of personal information we collect and how it is collected

    “Personal Information” refers to any information about you or that can be used to identify you, such as your name, address, phone number, and email address, as well as information about your transactions with the service, such as reward points, account balances, redemption history, and account activity, as well as your non-public information related to the service or linked to the information mentioned above. Information that is not tied to or associated with your Personal Information, such as aggregate data, is referred to as “Anonymous Information.” By itself, anonymous data does not enable the identification of a person.   •  Information on your transactions with merchants using the Service, as well as the products and services you buy.
  •  The information you consider giving the merchant as a part of your contacts with them.
  •  This service requires the following information to execute a redemption transaction: your name and associated shipping information.
  •  Information such as files and messages you save with your e-kupon account.
  •  When you react to or contact us via email, we need information like your name and email address, as well as any other material in the email, to help us support you.

    (b) Through the platform, technology collects information. Consider the following scenario:

  •  Your user information includes your web browser type, Internet Protocol (IP) address (a number automatically assigned to a computer when you use the Internet that may change depending on usage session), domain name, user profile, and/or visit date/time records, as well as a unique device identifier, or better known as an Android ID, concerning your mobile phone.
  •  With your agreement, we may collect personal information from third parties, such as the content of your profile or other types of personally identifiable information.
  •  Cookies and URL information are used to keep track of the date and time of your visit, as well as the content you looked for and viewed. “Cookies” are little pieces of information that a website sends to your computer’s hard disc while you explore it.   •  To record the date, time, search, and display information connected to your mobile phone, information from the corresponding technology used in combination with the mobile phone, including Android ID, is used.
  •  Third-party analytics services, such as Google Analytics (https://www.google.com/analytics) or Google AdSense (https://www.google.com/adsense), collect information on how you use and interact with the Platform and these services. Cookies may be used by third-party analytics services to gather information about the websites you visit, your IP address, the date and time of your visit, and the websites that brought you to this Platform.

    (c)Information from third parties or other non-prohibited persons that have secured your authorization to disclose personal information about you.


    (d) Should you invite a third person to create an e-kupon account, we will collect information about them from you. To send emails and follow up with third parties, we will gather your name and email address.

    How we use your personal information

    (a) General uses or those collected by technology. In addition to the means described above, we may use your personal information either to respond to your request or to assist us in providing better service, whether or not through technological methods for one or more of the purposes the following:
  •  to supply this service;
  •  to help create and secure your e-kupon account in our network;
  •  to identify you as a user in our system;
  •  to improve the management of our services;
  •  to keep visitors informed of any updates to our services;
  •  to promote our services; or products, services, and special offers of products and services from third parties that may be of interest to you;
  •  to improve and customize the quality of the experience when you interact with our services;
  •  to send a welcome email and confirm ownership of the email address provided when your e-kupon account is created;
  •  to send administrative email notifications, such as safety advice or support and maintenance;
  •  to answer questions related to job opportunities or other requests;
  •  to submit offers and promotional materials related to our services and for other marketing purposes;
  •  to track user-specific information related to sites accessed or visited;
  •  to improve and customize the quality of the experience when you interact with the platform, and the service;
  •  for all operational purposes including account management, billing, and collection, audits, reporting, and investigations;
  •  to enforce or defend our legal rights and/or obtaining legal advice;
  •  to assist in the prevention, detection, or investigation of crime or possible criminal activity or for the administration of justice;
  •  for security and internal audit purposes;
  •  for other purposes as may be directed or agreed to by you; and
  •  for all other purposes connected with or incidental to the foregoing.

    (b) Creating Anonymous Information. We may also not publish or aggregate your personal information by excluding information (such as your name) that makes such data identifiable. This Anonymous Information may be used to personalize the service, including to direct certain ads more relevant to you or to analyze demand and usage patterns so that we can improve the content of the service and improve platform navigation or for any market surveys that related, either internally or through third parties.

    Disclosure of your personal information

    Subject to any laws (including regulations, guidelines, and/or obligations) applicable to us and our affiliates (as defined below) (whether within or outside Malaysia), we may disclose your personal information as set out below and elsewhere in this Privacy Policy:

    (a) Third-Party Service Providers. We may share your Personal Information with third-party service providers who may be located in or outside Malaysia

  •  to provide the services we offer to you through this Platform;
  •  to conduct quality assurance tests;
  •  to assist with account registration;
  •  to provide technical support; and/or
  •  to provide other services to us. Third-party service providers are not required to use your personal information other than to provide the services requested by us.

    (b) Affiliates and Acquisitions. We may share some or all of your personal information with our co-operators, or other companies under the same control (“Affiliate”), where we will require our affiliation to respect this Privacy Policy.


    (c) Social Networks (SNS). The service may, with your permission, automatically send, information on your SNS profile based on your recent activities (e.g., you used coupons to purchase the latest movie tickets). Please see the section on Third-Party Websites below for more information.


    (d) We Do Not Share Personal Information with Advertisers, but..we do, however, allow advertisers to request that their ads be directed to specific users (e.g., users in specific geographic locations, or specific ages, genders, and/or interests). If you interact with a particular ad, the advertiser (or a company that works with the advertiser, for example, an advertising agency or advertising network) can define certain characteristics about you.


    (e) Third Parties directed or agreed to by you. We may share your personal information with any person directed by or consented to by you.


    (f) Professional Advisors. We may share your personal information with our professional advisors including but not limited to legal advisers, tax advisers, financial advisers, auditors, insurance brokers, etc.


    (g) Other disclosures. No matter what choices you make about your personal information, we may disclose personal information if we believe in good faith that such disclosure is necessary.

  •  in connection with any legal investigation;
  •  to comply with applicable law or to respond to subpoenas or warrants served on us;
  •  to protect or defend the rights or property of us or users of the Service; and/or
  •  to investigate or assist us in preventing any or potential breaches of the law, this Privacy Policy, or the Terms of Use. We may also need to transfer your data outside Malaysia for the purposes and to third parties set out in this Policy.
  • Third party websites

    You will leave the service and be redirected to other websites and businesses that may collect personal information or Information Without your Name if you click on a link or, in the case of smartphones and mobile devices, swipe left to access any website or location. We have no control over, do not review, and cannot be held liable for the content of external websites. This Privacy Policy does not apply to external websites or their content, nor to any data collecting that occurs after you click on a link or swipe left to visit an external website. You will be able to connect with third-party services as well as your social media accounts by using this service. By signing in to your SNS through our Platform, your SNS will issue us with a token that will enable them to identify us when we apply to access your account information or post information on your SNS profile on your behalf. You can disable our access to any of your SNS accounts at any time by changing the necessary settings in your SNS account settings, however, this may affect the services we provide to you. Furthermore, certain actions in the service may be automatically posted to your SNS profile when you engage in them. You can turn off this feature at any anytime by login into your SNS profile and choosing the option to turn it off.

    Storage and security of your personal information

    We prioritize protecting the security of your personal information, and we will assess and apply the most up-to-date technical and organizational security measures regularly to ensure the confidentiality and security of all of your personal information. This includes contractual relationships with relevant third parties, and we will make every effort to ensure that they adhere to our minimum requirements. Your personal information will be maintained by the Privacy Policy and/or the terms and conditions of your agreement for the duration of your engagement with us, or for as long as is required by applicable laws or regulations to protect our interests. To access your e-kupon account information, we will also require you to enter your password, which should not be shared with anyone, and we will require you to enter the same password again to access any sensitive information, such as credit card information. Disclaimer: No method of transmission over the Internet, or technique of electronic storage, is completely secure. As a result, while we take reasonable steps to safeguard your personal information, we cannot guarantee complete security.

    Your right to access and correct your personal information

    (a) Optional. We give you options regarding the collection, use, and sharing of your personal information. However, if you refuse to provide us with any personal information that is important to us to enable us to process your application/request (for registration example), you may not be able to process your application/request or provide you with this service. From time to time, we will send you free brochures and emails promoting the use of this service. When you receive a brochure or promotional communication from us, you may indicate the option to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the “unsubscribe” instructions provided in the email you receive, by terminating your account your e-kupon or by contacting us directly (please see our contact information below). Even if you have stated your email preferences, you may not opt-out of communications related to the terms and conditions of this service, including any changes to the Terms of Use or Privacy Policy, unless you deactivate the use of this service.


    (b) Changes to personal information. You can access or change your personal information in our storage or control through your profile in your e-kupon account. Any request for access to correct personal information may be subject to payment as well as to applicable legal provisions. We reserve the right to reject requests that affect the security and privacy of other individuals ‘personal information as well as requests that are impractical or not made in good faith. In addition, it is important to note that personal information recorded by the system is non-editable. When we delete any information, it will be deleted from the active database, but may remain in our archive. To the extent permitted by law, we may also retain your information for the prevention of forgery (“fraud”) or similar purposes as required by law.

    What if the personal information provided to you is incomplete?

    It is required to provide us with your personal information to the extent specified (for example, when you initially log in to an e-kupon account) for us to process your application to create an e-kupon account or to offer you our services. We may not be able to complete your application or provide you with our services if you refuse to supply the needed personal information.

    Revisions and amendments to the privacy notice

    We may review and update this Privacy Policy from time to time to reflect changes in law, in business practices, procedures and structures, and changes in society’s privacy expectations. The latest version of the Privacy Policy will be available and available on the platform. If we believe, in our sole discretion, that any amendments made to this Privacy Policy are substantive, a notice of such amendments will be made available on the platform or through any other means of communication we deem appropriate, for example, sending to the last email address you gave us. Please note that at all times you are responsible for updating your personal information and providing us with your current email address. If the last email address you provided to us is invalid, or for any reason is unable to receive the notice stated above, the delivery of the email containing such notice by us will be deemed to be effective notice of the change. Your continued use of our Services, upon notice of such changes, indicates your acknowledgment of your acceptance of such changes and that you agree to be bound by the terms and conditions of such changes.
